About these Terms

These Terms of Service (“Terms”) are a binding legal agreement between you and JB United LLC, a California limited liability company doing business as College Price Check (“College Price Check,” “we,” “us,” or “our”). They govern your use of our websites, applications, and other offerings (together, the “College Price Check Platform” or the “Platform”).

The College Price Check Platform lets users (“Members”) publish, offer, search for, and book appointments with college, career, and financial aid advisors. Members who publish and offer appointments are “Advisors.” Members who search for, book, or attend appointments are “Guests.” A Guest may be a student, a parent or guardian, or anyone helping a student prepare for college, succeed in college, pay for college, or plan a career. An Advisor’s public profile, including their description, the conversation topics they offer, photos, price, and availability, is a “Listing.” A one-on-one session a Guest books with an Advisor through a Listing, usually held by video call, is an “Appointment.”

As the provider of the College Price Check Platform, College Price Check does not own, control, offer, or manage any Listing or Appointment. We are not a party to the agreements Advisors and Guests make directly with each other. College Price Check is not a college or university, an admissions or financial aid office, a lender, a financial or investment adviser, a tax preparer, a law firm, an employment agency, or a counseling or mental health provider, and Advisors are not our employees. Except as a limited payment collection agent for Advisors, we do not act as an agent for any Member. Appointments are scheduled through a Calendly account that College Price Check manages. Guests pay for Appointments through College Price Check, which collects those payments on the Advisor’s behalf and pays them out to the Advisor, as described in Fees and payments for Advisors. By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform. You must be at least 18 years old to use the Platform, or use it with the knowledge and consent of a parent or legal guardian who agrees to these Terms on your behalf. You must be at least 18 years old to be an Advisor.

College Price Check’s role

We offer you the right to use a platform that lets Members publish, offer, search for, and book Appointments. We work hard to make sure Members have great experiences, but we do not and cannot control the conduct of Advisors or Guests. You acknowledge that College Price Check has the right, but not the obligation, to monitor use of the College Price Check Platform and to verify information Members provide. For example, we may review, monitor, disable access to, remove, or edit Listings, reviews, booking information, or other Content to:

• (i) operate, secure, and improve the Platform, including for fraud prevention, risk assessment, investigation, and customer support purposes
• (ii) ensure Members’ compliance with these Terms
• (iii) comply with applicable law or the order or requirement of a court, law enforcement, or other administrative agency or governmental body
• (iv) address Content that we determine is harmful or objectionable
• (v) take actions set out in these Terms
• (vi) maintain and enforce any quality or eligibility criteria, including by removing Listings that don’t meet them

Marking a Listing as reviewed is not an endorsement, certification, or background check, and a Listing marked “pending review” has not been reviewed at all.

Members acknowledge and agree that College Price Check administers these Terms and its policies and standards (such as the cancellation policy and our standards for Advisors), including decisions about whether and how to apply them to a particular situation, at its sole discretion. Members agree to cooperate with and assist College Price Check in good faith, and to provide the information and take the actions we reasonably request, in any investigation we undertake into the use or abuse of the Platform. Except as a limited payment collection agent for Advisors, College Price Check does not act as an agent for any Member.

What Appointments cover

Advisors choose the conversation topics they offer on their Listing. Topics generally fall into four areas:

• Preparing for college: course planning and A-G requirements, standardized tests, extracurricular activities, building a college list, applications, and personal statements or Personal Insight Questions.
• Paying for college: the FAFSA and CADAA, scholarship applications, comparing financial aid offers, cutting costs, and student loans.
• Succeeding in college: academic planning, getting involved on campus, first-generation student planning, and building confidence and self-advocacy.
• Planning a career: internships, networking, résumés and LinkedIn profiles, interviews, and life after college.

Whatever the topic:

• No guaranteed outcomes. Admissions, scholarship, financial aid, loan, internship, and hiring decisions are made by colleges, committees, lenders, and employers, not by Advisors or College Price Check. Advisors cannot guarantee any result.
• Your application is your own. Advisors may brainstorm with you and give feedback on essays, Personal Insight Questions, and applications. They should not write or submit them for you, and you are responsible for following each institution’s rules.
• Financial aid and loans. Guidance on aid, scholarships, and loans is educational, not financial, tax, legal, or investment advice. Confirm with your school’s financial aid office, Federal Student Aid, or a licensed professional before you borrow or file. Never share your FSA ID, passwords, or full Social Security number with an Advisor, and Advisors must never ask for them.
• Coaching, not counseling. Conversations about confidence, belonging, or stress are coaching, not therapy or mental health care. If you are in crisis, call or text 988 (in the U.S.).

Other content on the Platform, including articles and Listings, is likewise for informational and educational purposes only and is not professional advice. College Price Check is not affiliated with any college, university, or government agency.

Booking an Appointment

Each Advisor sets the price, length, topics, and availability of their Appointments. The price shown on a Listing is the price per Appointment unless it says otherwise when you book. You book through the scheduling page on the Listing and pay through College Price Check, which collects your payment on the Advisor’s behalf as their limited payment collection agent. Your payment to College Price Check counts as payment to the Advisor, and the Advisor remains responsible for providing the Appointment. Payments are processed by Stripe. Calendly’s and Stripe’s own terms also apply to your booking and payment.

Cancellations and rescheduling

• Cancel at least 1 day (24 hours) before the start time for a full refund.
• Reschedule at least 1 day before the start time at no extra cost.
• Cancellations made less than 1 day before the start time, and missed Appointments (“no-shows”), are not refundable unless the Advisor chooses to offer a refund.
• If an Advisor cancels or does not attend, you are entitled to a full refund or a rescheduled Appointment.

Refunds owed under this policy are issued by College Price Check on the Advisor’s behalf, to your original payment method. If you have questions about a refund, email hello@collegepricecheck.com.

During your Appointment

Appointments take place by video call. You’ll receive the link by email when you book. Anyone under 18 should have a parent or guardian nearby during the Appointment. Please be respectful and on time. Advisors may end an Appointment in which a participant is abusive or harassing.

If something went wrong with an Appointment, email hello@collegepricecheck.com. We’ll try to help resolve it, but we can’t guarantee an outcome, because the Appointment is between you and the Advisor.

Being an Advisor

If you publish a Listing, you also agree to these additional terms:

• Accurate Listing. Everything on your Listing is true and kept up to date, including your name, photos, education, experience, topics, price, and availability. Do not claim credentials, affiliations, or results you don’t have.
• Independent business. You run your own independent business and are self-employed. You are responsible for your own services, taxes, insurance, licenses, and compliance with applicable law. Nothing in these Terms creates an employment, partnership, or joint-venture relationship with College Price Check, or any agency relationship other than the limited payment collection agency described in Fees and payments for Advisors.
• Proof of experience. Before your Listing goes live, you provide proof of at least 3 years of relevant experience helping students prepare for, pay for, or succeed in college, or plan a career, and you allow us to verify it.
• Honor your bookings. Keep your availability current, attend the Appointments you accept, and deliver the topics described on your Listing.
• Stay within the topics. Do not promise specific admissions, aid, scholarship, loan, or job outcomes. Do not write or submit application materials on a Guest’s behalf. Do not give legal, tax, or investment advice unless you are licensed to, and do not provide therapy or mental health treatment.
• Protect Guest information. Never ask for a Guest’s FSA ID, passwords, or full Social Security number. Use any information a Guest shares only to provide the Appointment, keep it confidential, and do not sell it.
• No kickbacks. Do not accept referral fees, commissions, or anything else of value from colleges, lenders, agents, or other third parties in connection with the advice you give Guests.
• Work with minors responsibly. Keep conduct professional and appropriate at all times, and do not arrange contact with a minor outside a scheduled Appointment without a parent or guardian’s consent.

Your Listing content

You keep ownership of the photos, text, and other content you add to your Listing. You grant College Price Check a worldwide, non-exclusive, royalty-free license to host, display, reproduce, adapt (for example, resizing or cropping), and promote that content on the Platform and in marketing for the Platform, for as long as your Listing is published and for a reasonable period afterward. You confirm you have the rights to everything you upload, including permission from anyone who appears in your photos.

We may change how your Listing is formatted, decline to publish it, feature or un-feature it, or remove it at any time, including if we believe it breaks these Terms or puts Members at risk.

Fees and payments for Advisors

• Limited payment collection agent. You appoint College Price Check as your limited payment collection agent, solely to accept payments from Guests for your Appointments and to issue refunds on your behalf. A Guest’s payment to College Price Check counts as payment to you, and you will not seek payment for that Appointment from the Guest.
• Payouts. We pay out the amounts collected for the Appointments you’ve held twice a month, generally around the 15th and the last day of the month. Payout timing may vary, for example because of weekends, holidays, bank processing times, or a pending refund or dispute.
• Our margin and card processing. For each Appointment, we deduct our margin of 10% of the Appointment price and card processing of 2.9% + 30¢ before paying you out.
• Technology and team fee. Once your Listing is live, you pay a technology and team fee of $99 per month. It is a subscription, billed whether or not you have bookings that month. There is no commitment, and you can cancel at any time; no further technology and team fees are charged after you cancel.
• Refunds and disputes. Refunds owed to Guests under the cancellation policy, and amounts reversed through card disputes, are deducted from your payouts.
• Taxes. Nothing is withheld from your payouts. You are responsible for your own taxes. We may collect tax information from you and issue tax forms as required by law.
• Changes to fees. We may change these fees with at least 30 days’ notice to Advisors.

Reviews and ratings

Reviews and ratings must reflect a genuine Appointment with an Advisor. Do not post fake reviews, review yourself, or offer or accept anything of value in exchange for a review. Advisors may not pressure Guests to change or remove a review. We may remove reviews that we believe are fake, abusive, off-topic, or otherwise break these Terms. We do not verify every review, and reviews are the opinions of the Members who wrote them, not College Price Check.

Acceptable use

When using the Platform, you agree not to:

• Submit false, misleading, or fraudulent information
• Impersonate any person or entity, or misrepresent an affiliation
• Harass, threaten, or harm any Member
• Scrape, crawl, or use automated tools to access the Platform
• Reverse-engineer, interfere with, or disrupt the Platform or its infrastructure
• Use the Platform to solicit Members for purposes unrelated to Appointments, or to send spam
• Resell or redistribute the Platform, or use it in any way that could harm other Members or College Price Check

Your data

We use the information you provide, such as your name, email address, and booking details, to run and improve the Platform. When you book an Appointment, both College Price Check and your Advisor receive the booking details. We do not sell your data. Our Privacy Policy has the full details.

Information on the Platform

Information on the Platform, including Listings, articles, and figures about college costs or savings, may come from Advisors or third-party sources we don’t control. It may not be current, complete, or specific to your situation, and we make no representation about its accuracy. Results vary with your school, aid offer, and household circumstances.

Intellectual property

The Platform, including its content, design, text, graphics, logos, and software (other than content provided by Members), is owned by or licensed to JB United LLC and protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose. Do not copy, reproduce, distribute, modify, or create derivative works from the Platform without our prior written permission.

If you send us feedback or suggestions, we may use them without any obligation to you.

Third-party services

The Platform relies on third-party providers, including Calendly for scheduling, Stripe for payments, and video-call tools for Appointments, and may link to other websites. Your use of those services is governed by their own terms and privacy policies. We are not responsible for their content, availability, or practices, and a link does not mean we endorse them.

Disclaimer of warranties

Limitation of liability

Indemnification

You agree to indemnify, defend, and hold harmless JB United LLC and its officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right; (d) any content you submit; or (e) if you are an Advisor, any Appointment or services you provide.

Suspension and termination

We may suspend or terminate your access to the Platform, or remove any Listing or content, at any time, with or without cause or notice, and without liability to you. You may stop using the Platform at any time. Advisors can ask us to unpublish their Listing by emailing hello@collegepricecheck.com. The sections on College Price Check’s role, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

Disputes and arbitration

Before filing a claim, please email hello@collegepricecheck.com so we can try to resolve it informally. If we can’t resolve it within 30 days, any dispute, claim, or controversy between you and College Price Check arising out of or relating to these Terms or the Platform will be resolved by final and binding arbitration instead of in court. Arbitration will be conducted by a nationally recognized arbitration organization (such as JAMS or the American Arbitration Association) under its rules then in effect, in Contra Costa County, California, unless the parties agree otherwise. Judgment on the award may be entered in any court of competent jurisdiction.

Exceptions. Either party may bring qualifying claims in small claims court, and may seek injunctive or other equitable relief in court to prevent actual or threatened infringement of intellectual property rights.

Class action waiver

If this class action waiver is found unenforceable, this arbitration section will not apply, and disputes will be resolved in court.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. For any matter not subject to arbitration, you consent to exclusive jurisdiction and venue in the state and federal courts located in Contra Costa County, California.

Copyright and DMCA

We respect intellectual property rights. If you believe content on the Platform infringes your copyright, send a written notice to our copyright agent:

Your notice must include: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material and where it appears on the Platform; (3) your name, address, telephone number, and email address; (4) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner; and (6) your physical or electronic signature. We may remove infringing content and terminate the accounts of repeat infringers.

Changes to these Terms

We may update these Terms from time to time. When we do, we’ll change the “Last updated” date above, and for significant changes we may also notify you by email. Continuing to use the Platform after changes take effect means you accept the updated Terms.

General

Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and JB United LLC about the Platform. They replace any earlier agreements on the same subject.

Severability. If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the rest of these Terms will remain in effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not transfer your rights under these Terms without our consent. We may assign ours in connection with a merger, acquisition, or sale of assets.

Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, government action, internet or third-party platform outages, or labor disputes.
